Access to and use of the Space Climate Observatory (SCO) website are subject to this legal notice. In this respect, by having access, or by using the SCO website, the web user agrees to be automatically bound by this legal notice as well its successive modifications done by CNES at its sole discretion and without prior notice.
This legal notice and disclaimer are governed by French law. Any dispute arising out or in connection with this legal notice and disclaimer shall be subject to the exclusive jurisdiction of the courts of Paris (France).
 
The SCO website broadcasts non contractual information on the CNES activities.

  • Liability

Any data, and more generally the content of the SCO website are the CNES property, or a third party property and for which CNES has obtained a right of use. 
They are made accessible on an “as is” and “as available” basis. 

CNES gives no warranty nor represents, without limitation, that (i) this service and its supporting elements will meet your requirements, (ii) the same will be periodically uninterrupted, or failure and error free, (iii) the data that may be displayed through the SCO website will be accurate, up to date or reliable, (iv) the quality of any data, information or other material obtained will meet the web user expectations and that such data, information and other material will be failure and error free, or that any errors will be corrected. Access to and use of the SCO website is therefore made at the sole web user responsibilities. 
In no event the CNES shall be held liable for any direct, indirect or consequential damages, or any damages of any kind and arising out or in connection with access, use, unavailability of the SCO website, or websites which are linked to it, including loss of data or programs, interruptions, changes, updates, modifications of data broadcasted on the SCO website, occurrence of bugs, loss of use, financial loss, any deterioration or infection by viruses of the web user equipment (including but not limited to software, hardware, connections and any system or network).
CNES reserves the right, at any time and without prior notice, to make changes, update, interrupt or modify all data broadcasted on its website, including the selection and arrangement thereof, or its services, either temporarily or permanently.
 
CNES shall not be held liable for any losses, costs and expenses incurred in relation with any breach of this legal notice or resulting from, or in relation with the use made by the web user or access to the website. 
The web user shall not, voluntarily or involuntarily, insert viruses or files of whatever nature disturbing the operation of the website. In this case, he should assume all liability.

The web user shall not use this website for illicit and prohibited ends.

  • Confidentiality

During the use of the SCO website, personal data on the web user may be gathered. Except for case expressly indicated to the web user, such personal data will be treated by CNES as confidential and will not be shared or transferred to third parties.

At the time of the gathering, CNES mentions the purpose and the person responsible of the use and conservation of its personal data.

CNES shall not be held liable for the access, the content  and the use of the third party linked website, including, without limitation, any gathering of personal data, cookies’ installation.
The web user assumes all risks concerning access to these third parties linked websites.

  • Cookies

 This website may use “cookies” (small data files for record keeping of the web user connection purposes). CNES may have access and record this information during the visits of the web user. Such information does not aim at identifying the web user. The web user can change the personal configuration of his navigator to prevent the cookies registration.

  • Intellectual Property rights

All intellectual property rights on the SCO website, including without limitation all patented information, copyrights, trade names, trademarks, logos, database, documents, texts, graphics, pictures, photographs, sound files, video files are the exclusive property of CNES or a third party property and for which CNES has obtained a right of use. 
Except otherwise expressly provided, access and use of the SCO website shall not be construed as assigning nor granting any license or right of use in respect of intellectual property rights. 

  • Rights granted

CNES grants to the web user a personal, free of charge, non-exclusive and non-transferable right of access and use of its website. Any other rights are expressly excluded.

Therefore, and without limitation, the rights to (i) reproduce, represent, adapt and/or translate, (ii) extract, or (iii) create any derivative work from all or part of the SCO website and/or its content, are formally and strictly forbidden except in the frame of the private copy exception or for educational purpose.
